Terms and Conditions

123 Lab Diamonds

These Terms and Conditions ("Terms") govern the purchase of lab-grown diamonds and related jewelry products ("Products") from 123 Lab Diamonds ("Company," "we," "us," or "our"). By placing an order and making a payment, you ("Customer" or "you") agree to be bound by these Terms.

1. Acceptance and Order Confirmation

All orders are subject to acceptance by the Company. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to instances of suspected fraud, pricing errors, or inventory unavailability. An order is only confirmed once full payment is received and processed.

2. Product Images, Description and Availability

We strive to describe our Products accurately; however, lab-grown diamonds shown in our online shop are unique, and slight variations in carat, color, clarity, and cut may occur due to hand-made and photo lighting concern. All Products are subject to availability. If a Product becomes unavailable after an order is placed, we reserve the right to cancel the order and issue a full refund in thirty working days, which shall be your sole remedy.

3. Pricing and Payment

All prices are subject to change without prior notice. The price charged for a Product will be the price in effect at the time the order is placed. Full payment must be received prior to the shipment of any Product. The Customer is responsible for all applicable taxes, customs duties, and shipping fees, unless otherwise explicitly stated by the Company.

4. Shipping and Risk of Loss

Delivery dates are estimates and not guaranteed. The Company is not liable for any delays caused by shipping carriers, customs clearance, or force majeure events. The risk of loss and title for the Products pass to the Customer upon our delivery of the Products to the carrier.

5. Certification

All our lab grown diamond jewelry sets shall be verified and certified by independent international gemological certification body (i.e. IGI or others) only for one carat or above. Any jewelry sets under one carat shall not be verified and delivered together with any official certificate.

6. Returns, Refunds, and Custom Orders

We accept returns of standard, non-customized Products strictly because of manufacturing defeats found within fourteen days of delivery (conditional that such intended returns must be firstly reported to our customer service team through available communication channels within five days upon receipt), provided the Product is in its original, unworn condition with all accompanying documentation and certificates. The Company reserves the right to reject returns that do not meet these criteria upon our inspection. Return shipping costs and insurance are the responsibility of the Customer.

No returns, refunds or exchange is acceptable due to personal expectation discrepancies and/or sizing issue upon receipt.

Custom, bespoke, or engraved orders are strictly non-refundable and non-exchangeable under whatever reason unless manufacturing defeats found. Professional inspection and investigation shall be conducted before confirmation.

7. Disclaimer of Warranties

To the maximum extent permitted by law, all Products are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

In no event shall 123 Lab Diamonds, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your purchase. The Company's total cumulative liability for any claim arising from or relating to the purchase of Products shall not exceed the actual amount paid by the Customer for the specific Product in dispute.

9. Intellectual Property

All designs, images, logos, and content provided by the Company remain the exclusive intellectual property of 123 Lab Diamonds. Unauthorized reproduction or distribution is strictly prohibited.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is registered, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the purchase of Products shall be resolved exclusively through binding arbitration or in the competent courts of the Company's jurisdiction, at the Company's sole discretion.

11. Amendments

The Company reserves the right to modify these Terms at any time. The Terms in effect at the time of your purchase will govern your transaction.
